This isn't in itself the thing that Fosco didn't see coming; he was aware of the possibility and prepared to suppress the report of the death until after Laura's arrival in London. What catches him out is that Anne's death happens while he's out of the house and the innocent parties to the deception, in his absence, follow their own instincts — one of the servants runs to fetch a doctor, and the doctor, meaning to spare the bereaved further suffering, volunteers to handle all the paperwork himself — so that the death is on the official record with the correct date attached before Fosco even knows it's happened.
