At the start of the film, in the 1970s, rather than kill the man, Micah just ties up a security guard who spots him, which makes it possible for the police to identify him later on. Finch is able to scheme, scamper, and talk his way out of most situations, but when put in a do-or-die situation at the end of the movie by Critical Joe to blast his way out of the hotel room, he can't bring himself to shoot Nimble and Fife.

They do investigate the garden later - too late - and grill Finch on the purposes of the pigeons - which he shakes off with a very plausible lie.
